(CBrief) – President Joe Biden just got a tough break from a federal court regarding his plans to cancel student loans.

The U.S. Court of Appeals for the 8th Circuit on Friday ordered the administration not to begin processing any student loan debt forgiveness applications after millions of people applied, The Washington Post reported.

The lawsuit was brought by six conservative states and the judge has agreed to expedited the case.

“We are pleased the temporary stay has been granted,” Nebraska Attorney General Doug Peterson said. “It’s very important that the legal issues involving presidential power be analyzed by the court before transferring over $400 billion in debt to American taxpayers.”

The decision arrives a day after U.S. District Judge Henry E. Autrey, a George W. Bush appointee, dismissed the states’ lawsuit for lack of standing. Earlier Thursday, U.S. Supreme Court Justice Amy Coney Barrett denied a separate request by the Wisconsin Institute for Law and Liberty, working on behalf of a taxpayer’s association, to pause the program.

Biden’s loan relief plan would cancel up to $10,000 in federal student debt for borrowers who earn up to $125,000 annually, or up to $250,000 for married couples. Borrowers who received Pell Grants are eligible for an additional $10,000 in forgiveness. People have until the end of 2023 to apply, but the administration has encouraged borrowers to do so by Nov. 15 in hopes of it being processed before a pause on student loan payments ends Dec. 31.

White House press secretary Karine Jean-Pierre said in a statement that the appellate court’s order does not prevent people from applying for debt relief, and the administration encourages eligible borrowers to continue to do so. It also does not prevent the Education Department from reviewing applications, she said.

She said that “the order does not reverse the trial court’s dismissal of the case, or suggest that the case has merit. We will continue to move full speed ahead in our preparations in compliance with this order.”

“Our student loan plan lowers costs for Americans as they recover from the pandemic to give everybody a little more breathing room,” President Biden said before the decision. “Republican members of Congress, Republican governors are doing everything they can to deny this relief. Their outrage is wrong and it’s hypocritical.”

“Tens of millions of Americans have already rushed to apply for debt cancellation, an indication that borrowers are struggling, anxious and eager to see this burden lifted,” Natalia Abrams, founder of the Student Debt Crisis Center, said. “The President’s student debt cancellation plan is a bold solution to these challenges and frivolous lawsuits will not stand in the way.”

“Conservative Justice Amy Coney Barrett rejected the motion from a Wisconsin group without offering an explanation. The Brown County Taxpayers Association filed the motion Wednesday, asking the court to immediately pause the loan relief program while it moves forward with litigation against the Biden Administration,” Forbes reported.

“A federal district court tossed a lawsuit from the group aiming to stop the program, which they have since appealed to the 7th Circuit Court of Appeals. The motion to the Supreme Court argued the program should be halted immediately because Biden overstepped his authority by authorizing loan forgiveness, which they claimed will lead to a gargantuan increase in the national debt,” the outlet added.

The student-loan forgiveness application site officially went live on Monday.

“After conducting beta testing over the weekend, President Joe Biden — alongside Education Secretary Miguel Cardona — announced that the application website is officially live, and borrowers can apply for up to $20,000 in debt relief that will start being processed by the Education Department. During his remarks, Biden noted that over 8 million borrowers applied over the weekend without a glitch or any difficulty,” Business Insider reported.

“It means more than 8 million Americans are starting this week on their way to receiving life-changing relief,” Biden said. “Millions more are going to have the opportunity to do it as well. As millions of people fill out the application, we’re going to make sure the system continues to work as smoothly as possible.”

(Slay News) – The Chinese Communist Party (CCP) has been using its social media app TikTok to monitor the physical location of specific American citizens, according to reports.

The team behind the monitoring project — ByteDance’s Internal Audit and Risk Control department — is led by Beijing-based executive Song Ye, who reports to ByteDance cofounder and CEO Rubo Liang.

“The team primarily conducts investigations into potential misconduct by current and former ByteDance employees,” according to Forbes.

“But in at least two cases, the Internal Audit team also planned to collect TikTok data about the location of a U.S. citizen who had never had an employment relationship with the company, the materials show.

“It is unclear from the materials whether data about these Americans was actually collected; however, the plan was for a Beijing-based ByteDance team to obtain location data from U.S. users’ devices.”

TikTok is reportedly close to signing a contract with the Treasury Department’s Committee on Foreign Investment in the United States (CFIUS), which evaluates the national security risks posed by companies of foreign ownership.

CFIUS has been looking into whether the company’s Chinese ownership can let the Chinese government access personal information about U.S. TikTok users.

Biden signed an executive order in September detailing the specific risks CFIUS should look at when assessing foreign-owned companies.

The order wants to “emphasize the risks presented by foreign adversaries’ access to data of United States persons, for the surveillance, tracing, tracking, and targeting of individuals or groups of individuals, with potential adverse impacts on national security.”

“Like most companies our size, we have an internal audit function responsible for objectively auditing and evaluating the company and our employees’ adherence to our codes of conduct,” said ByteDance spokesperson Jennifer Banks in a statement.

“This team provides its recommendations to the leadership team.”

According to Forbes:

It is unclear what role ByteDance’s Internal Audit team will play in TikTok’s efforts to limit China-based employees’ access to U.S. user data, especially given the team’s plans to monitor some American citizens’ locations using the TikTok app.

But a fraud risk assessment written by a member of the team in late 2021 highlighted data storage concerns, saying that according to employees responsible for the company’s data, “it is impossible to keep data that should not be stored in CN from being retained in CN-based servers, even after ByteDance stands up a primary storage cetner [sic] in Singapore. [Lark data is saved in China.]” (brackets in original).

Moreover, a leaked audio conversation from January 2022 shows that the Beijing-based team was, at that point, gathering additional information on Project Texas.

In the call, a member of TikTok’s U.S. Trust & Safety team recounted an unusual conversation to his manager:

The employee had been asked by Chris Lepitak, TikTok’s Chief Internal Auditor, to meet at an LA-area restaurant off hours.

Lepitak, who reports to Beijing-based Song Ye, then asked the employee detailed questions about the location and details of the Oracle server that is central to TikTok’s plans to limit foreign access to personal U.S. user data.

The employee told his manager that he was “freaked out” by the exchange.

TikTok and ByteDance did not respond to questions about this conversation.

Oracle spokesperson Ken Glueck said that while TikTok does currently use Oracle’s cloud services, “we have absolutely no insight one way or the other” into who can access TikTok user data.

“Today, TikTok is running in the Oracle cloud, but just like Bank of America, General Motors, and a million other customers, they have full control of everything they’re doing,” he said.

(Slay News) – U.S. prosecutors are raising the alarm after an investigation uncovered evidence that the Chinese Communist Party (CCP) has had back-door access to America’s election data.

The bombshell discovery was revealed by Los Angeles County prosecutor Eric Neff, who described the finding as “probably the largest data breach in United States history.”

Neff said Chinese contractors working for a Michigan-based software company had “direct control over U.S. election data.”

According to Neff, data has been funneled back to the CCP through an app for poll workers called PollChief.

The prosecutor describes the volume of data in the breach as “astounding.”

Neff says the breach was discovered during investigations for the criminal case against Eugene Yu, the CEO of Konnech.

As Slay News recently reported, Yu was arrested for allegedly storing Los Angeles election worker data on servers based in China.

The complaint issued by the L.A. District Attorney’s Office cited as evidence a message from a Konnech project manager through a Chinese-owned messaging app that said: “Any employee for Chinese contractors working on PollChief software had ‘super-administration’ privileges for all PollChief clients.”

Former CIA officer Sam Faddis put that statement in perspective in a Substack post.

“An individual with super administration access to a system can do effectively anything inside that system,” he wrote.

“He or she can delete data, steal data, alter data, change programming, etc.”

According to WND, the security breach through the Konnech software was discovered by the election integrity group True the Vote.

At an invitation-only event in the Phoenix area in August, True the Vote leaders Catherine Engelbrecht and Gregg Phillips disclosed that their team had notified the FBI, and the agents with whom they communicated were alarmed by the potential national security implications.

Later, however, after working together on a “counter-intelligence operation,” Engelbrecht and Phillips said the FBI turned against them, and they sought out independent researchers to assist.

One investigator, who attended the Arizona event, posting on his Kanekoa News Substack page, has identified Konnech’s Chinese subsidiary, Jinhua Yulian Network Technology.

Yu, who established the Chinese company in 2005, wrote on his website – according to an archived 2013 version – about his success with “Election Management Solutions Detroit” and “U.S. Overseas Voters.”

On the website, he praised the vision of the Chinese Communist Party leader at the time, calling him “Comrade Jiang Zemin.”

In a statement on Yu’s arrest earlier this month, True the Vote said it was “honored to have played a small role in what must have been a wide-ranging and complex investigation.”

“The organization is profoundly grateful to the Los Angeles District Attorney’s office for their thorough work and rapid action in this matter,” True the Vote said.

The non-profit – whose investigation of ballot trafficking was featured in the film “2000 Mules” – was sued last month by Konnech.

True the Vote said the lawsuit was an effort to try to silence the organization.

Konnech obtained an ex-parte temporary restraining order in secret, True the Vote said, so the election integrity group would have no opportunity to contest it.

Yu’s arrest came one day after the New York Times published a story mocking True the Vote as “election deniers” for claiming Konnech was storing personal information about poll workers on servers in China, posing a serious security risk.

Alluding to the New York Times, among others, True the Vote said Konnech “was assisted by many reporters who unblinkingly accepted their now discredited claims as fact, and simply repeated them.”

“Election integrity should not be a partisan issue, nor should media try to suppress all conversation about it in a way that benefits one party,” said Engelbrecht.

“We will continue to report evidence of threats to our election process and work with law enforcement to ensure our elections are a secure space for all American voters.”

(Slay News) – Disgraced former FBI agent Peter Strzok has claimed that the Jan. 6 riot on Capitol Hill was worse than the 9/11 terrorist attacks.

Strzok, who has been a central figure in promoting the phony Trump-Russia “collusion” hoax, said Monday that 9/11 was “nothing compared” to Jan. 6.

He made the comments during an interview with MSNBC’s Nichole Wallace on “Deadline White House.”

Wallace condemned FBI director Christoper Wray for failing to spout “one utterance” of connecting the dots between 9/11 and the Capitol riot.

She continued by adding that Jan. 6 will do down in American history as the “deadliest attack on the U.S. Capitol.”

“If you look at the scale in terms of threat to democracy — I mean 9/11 was a tragedy, we lost thousands of lives in a horrific way — we still mourn to this day,” Strzok said.

“But when you look at something that is an attack on democracy . . . that could actually bring about a fundamental change to American governance, as we understand it — 9/11 is nothing compared to January 6.”

Strzok then echoed MSNBC’s sentiments by slamming federal authorities for failing to get on the “same sort of war footing” that the U.S. paved following the events at the World Trade Center twenty years ago.

“Shame on everyone,” he added.

Strzok joined a list of political voices — primarily on the Left — to use the tragedy of 9/11 to amplify the anti-Trump narrative of Jan. 6.

Democrats and their allies want the public to believe that a mob of President Donald Trump’s supporters storming the United States Capitol has somehow become a more terrorizing event than two planes crashing into the World Trade Center, taking nearly 3,000 innocent lives.

Politifact reports January 6 involved approximately 2,000 people.

Some of them overturned barricades, clashed with police, and stormed the Capitol in an attempt to stop Congressional members from certifying the 2020 presidential election results.

Officials estimate about 800 people out of the massive crowd breached the Capitol grounds and building, leaving just over 200 people pleading guilty to one or more charges.

A bipartisan Senate report reviewed by The New York Times earlier this year found nine people died on or after January 6.

However, the only one who died by gunshot was 36-year-old military veteran Ashli Babbit.

However, reports from supporters and independent journalists tell a different story.

Witnesses allegedly say a small number of agent provocateurs climbing press risers long before any Trump supporter made it past the Capitol Reflecting Pool, which sits in front of the main lawn just before the main physical building.

Witnesses say following the alleged agitators riling up the crowd, only a fraction of the group joined in on the mob mentality.

Sources witnessed Capitol police officers allegedly opening barricades to access the grounds, riot police forming barriers until disbanding, which allowed the crowd to advance, and other authorities holding the door open for protestors to enter the building.

Once on the ground and in the building, witnesses said “protestors” could allegedly be seen changing their black bloc attire into Trump merchandise before creating more chaos.

Others have also said they witnessed rioters inside the building relaying cudgel-like weapons through windows to the people on the other side of the window frame.

All the while, the majority of Trump supporters on the ground screamed at the violent rioters to protest peacefully.

And mainstream media has repeatedly shared those images of the elderly women “storming the Capitol” while staying within the stanchions, taking pictures of the interior of the building.

Yet, Stzrok, who has been accused of causing long-term damage to the FBI’s reputation after the bureau fired him four years ago, and others have pledged to create the narrative that January 6 was the worst attack on American soil and a so-called deadly “insurrection.”
